Terms of Service

The rules for using humanoidoptimus-order.info and making a reservation. Please read them. They are written to be understood.

Agreement

These Terms of Service ("Terms") govern your use of humanoidoptimus-order.info (the "Site"), operated by Optimus ("we", "us"). By using the Site or making a reservation you agree to these Terms, our Pre-order Policy and our Privacy Policy. If you do not agree, please do not use the Site.

Eligibility

You must be at least 18 years old and able to enter into a legally binding agreement to make a reservation. You agree that the information you give us is accurate and that you will keep it up to date.

Reservations are not purchases

A reservation made on the Site expresses your interest in buying an Optimus unit and holds a place in the queue for your region. A reservation:

• is free of charge and does not require payment details;
• is not an offer to sell, an order or a contract of sale;
• creates no obligation for you to buy, or for us to sell, a product.

A contract of sale is formed only when, after we invite you to confirm, you place an order, accept the final price and terms of sale presented to you at that time and we accept your order in writing. See the Pre-order Policy for details.

Product information

We try to describe Optimus accurately. However, the product is still in development. Specifications, features, capabilities, images, finishes, delivery timelines and prices shown on the Site are targets and estimates that may change before first delivery. Illustrations are artistic renderings and may not reflect the final product. Final specifications will be provided before you confirm an order.

Prices

Prices shown are estimated starting prices in US dollars and exclude taxes, duties, delivery and installation unless stated otherwise. The price that applies to you is the one shown when you confirm your order. If the confirmed price differs from the price shown when you reserved, you are free to walk away at no cost.

Acceptable use

You agree not to:

• use the Site for any unlawful purpose or in breach of these Terms;
• submit false information or make reservations in another person's name without their permission;
• make reservations for resale or speculative purposes, or use bots or automated means to make reservations;
• attempt to gain unauthorised access to, interfere with or disrupt the Site or its infrastructure;
• copy, scrape or reproduce the Site's content except as permitted by law.

We may cancel reservations that we reasonably believe breach these Terms.

Intellectual property

The Site and its content, including text, drawings, illustrations, graphics, logos and software, are owned by or licensed to Optimus and are protected by intellectual-property laws. You may view and print pages for your personal, non-commercial use. Any other use requires our prior written permission. Third-party fonts and libraries are used under their respective open-source licences.

Third-party links

The Site may link to websites we do not control. We are not responsible for their content, policies or practices, and a link does not mean we endorse them.

Disclaimers

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, about the Site, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components. Warranties for purchased products are set out separately in the terms of sale and product warranty.

Limitation of liability

To the fullest extent permitted by law, Optimus will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the Site or a reservation. Because reservations are free, our total liability relating to the Site and reservations will not exceed USD 100.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or your statutory rights as a consumer.

Indemnity

You agree to indemnify and hold Optimus harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site, to the extent permitted by law.

Changes and termination

We may modify the Site or these Terms at any time. Updated Terms take effect when posted, and the "Last updated" date will change. Material changes affecting active reservations will be communicated by email. We may suspend or end the reservation program at any time. If we do, we will notify reservation holders, and because no payment is taken, no refund is required.

Governing law

These Terms are governed by the laws applicable at the operator's place of establishment, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory protections of the law of the country where you live, and you may bring proceedings in the courts of that country.
